§ 1 User

§ 2 Scope of application
These General Terms and Conditions apply to all legal transactions between the User and the consumer (according to Article 22.1 of the Civil Code (art. 22.1 kodeksu cywilnego), “A natural person making a legal transaction with an entrepreneur which is not directly related to his/her economic or professional activity is considered to be a consumer.”).
§ 3 Conclusion of the contract and storage of the contract text
The provisions of these T&Cs apply to orders which consumers conclude via the website www.polskieserce.org of the Polish Heart Foundation online shop.
The contract is concluded with the user (see § 1).
The presentation and description of goods on the website of the model shop www.modelldomain.de does not constitute an offer to conclude a contract.
By ordering a product by clicking on the “order with costs” button at the end of the ordering process, the consumer makes a binding offer to conclude a purchase contract. The contract is not concluded until the user sends an order confirmation by e-mail.
The text of the contract is saved for orders. Consumers receive an email with their order data and the applicable GTCs. Once the contract has been concluded, the order data can no longer be viewed online.
§ 4 Payment
Statutory VAT and other price components are included in the prices shown. Shipping costs are not included in the displayed price and may be additional.
Consumers can use the following payment options:
– Credit card/DEBIT
– Bank transfer
– Cash on delivery
– Paypal
§ 5 Delivery, delivery restrictions
Unless the description of the selected product expressly states otherwise, delivery takes place within 7 working days.
In the case of payment by bank transfer or Paypal, the time limit begins to run on the day following the issuing of the payment order.
§ 6 Transfer of risk
The risk of accidental deterioration or accidental loss of the goods remains with the user until the goods are handed over and passes to the consumer at the time of handover.
§ 7 Retention of title
The user retains ownership of the goods until the full purchase price has been received.
§ 8 Guarantee
Statutory warranty provisions apply.
